Special Conditions

1. Beams and joists are not included in the Sale of the Floors and must not be removed with them unless stated in the Catalogue. In the removal of floor boards the Purchaser shall exercise care not to damage such beams and joists.

2. Demolition of the Main Fabric will not be commenced until the expiration of 14 days after the day of the Sale in order that adequate protection may be given to the Fixtures. But it shall not prevent the owner of the Fabric from proceeding with the Demolition of the other parts of the House, provided such Demolition does not interfe~e with· the removal of Interior and Exterior Fixtures and Fittings, vide General Condition No.5.

General Conditions

1. The highest Bidder shall be the Purchaser and if any dispute arise between two or more Bidders, the lot in dispute shall be put up again and re-sold. The Auctioneers, may, at their discretion, refuse any bidding, and reserve the right to make biddings for each Lot, and to alter the lotting as may be considered necessary. The Auctioneers shall fix the rate of advance in the bidding at their sole discretion.

2. Purchasers shall give their names and place of abode, on the slips provided for such purpose on the inside cover of the Catalogue, and shall pay a deposit of twenty-five per cent. in part payment, or the whole of the purchase money if required, on or before the conclusion of the day of Sale on which their purchase or purchases have been made, in default of which the Lot or Lots so purchased shall be re-sold and the deficiency, if any, attending such re-sale, shall be made good by the defaulter. No Lot shall be removed or taken down during the Sale, and until full cash payment is made.

3. Transfer of Purchasers' names in the Sale Book cannot be recognised .

4. The Lots shall be paid for and taken away at Purchasers' expense and risk immediately after the Sale has concluded. The Vendors or Auctioneers are not to be held responsible for the torrect description, genuineness or authenticity of, or any fault, or defect in any Lot, and make no warranty whatsoever.

5. For convenience of purchasers attending from a distance, the time allowed for the removal of their purchase is fourteen days from the 19th April, 1950.

6. The Auctioneers reserve power of withdrawing or consolidating any Lots from the Sale, as also of selling in order other than that arranged in the Catalogue. (See Condition 1).

7. Should any mistake have been made in describing any Lot or Article, especially in stating makers' names and quality, such mistake will not be held to vitiate or affect the Sale of such Lot in any way, it being understood that intending purchasers should satisfy themselves on all points before purchasing.

8. The sizes stated are believed to be correct, and are given as a guide to Purchasers, but no guarantee is given as to Exact Measurements, and any difference arising between the actual measurements and those advertised, will not be allowed to vitiate or affect the sale of any Lot.

9. No Goods can (under any circumstances) be removed during the Sale, and must be paid for in cash, as above described under Condition 2. Cheques will not be accepted unless accompanied by a Banker's reference.

10. Upon failure of complying with any of the above Conditions, the money deposited shall be forfeited, and all lots unpaid for at the conclusion of the day of Sale on which their Purchase has been made may be sold by Public or Priate Sale, without any further notice to the Purchaser at this Sale, and the deficiency (if any) attending such re-sale shall be made good by the defaulter.

11. All matters of dispute other than the immediately aftermentioned, shall be submitted to the Auctioneers, whose decision shall be final. All matters, disputes or claims concerning damage sustained by any Purchaser to his, her or their property, from the time of Purchase during and until the removal of the same, shall be settled between the Purchasers themselves, none of whom shall have any claim against the Vendors on any ground whatever, and in the event of no such settlement being arrived at, such matters, disputes or claims shall be referred to the Auctioneers, for whose expenses in any such reference the Purchasers concerned shall be liable, and whose decision on such matters, disputes or claims, including expenses, shall be final and binding on the parties to the reference.

12. Should any damage be occasioned by any Purchaser to any property of the Vendors, which is either reserved or unsold, he, she or they shall make good the same or pay a sum in damages, which may be agreed between the Auctioneers, as representing the Vendors, and such Purchaser, or person, or failing agreement as to such damage may be assessed by the Auctioneers, whose decision shall be final.

13. All goods and materials purchased at the Sale shall be removed by the main drive leading to Northwold Lodge.
